Special Notice for Transportation Facilities:
It has been brought to the department’s attention that the requirements in 19 CSR 30-95.100(2)(C) for distance from schools, daycares, and churches do not mirror the similar requirements in 19 CSR 30-95.040(4)(B). The department is hereby notifying applicants for transportation facility certifications that it will, at the option of an applicant, entertain requests for variance from 19 CSR 30-95.100(2)(C) that seek to match transportation facility requirements with those of other medical marijuana facilities. Requests for variance must be made pursuant to 19 CSR 95.025(2)(B). Such requests may be made before an application is submitted, and the department intends to process these requests expeditiously.
