Licensees,

Pursuant to 19 CSR 100-1.020(1)(A), the Division of Cannabis Regulation (DCR) is granting a variance to the requirement in 19 CSR 100-1.120(1)(C)1.C. Manufacturing licensees will be considered in compliance with rule by complying with the alternative requirement described below regarding the number of milligrams of THC displayed under the universal symbol for marijuana-infused product. 

19 CSR 100-1.120(1)(C)1.C states that labels for infused products must display “the number of milligrams of THC in the package...” 

Licensees may use the intended or estimated milligrams of total THC content displayed under the universal symbol on the package, provided it is within ±10.0% of the actual number of milligrams of THC from the mandatory testing results that are in the package and listed on the label required by 19 CSR 100-1.120(1)(C)2.G.

DCR has determined that good cause exists for granting this variance as requiring an exact milligram value on the product packaging without allowance for reasonable manufacturing variability places an undue operational burden on manufacturing licensees and may result in unnecessary waste or relabeling, without providing a corresponding public health or consumer protection benefit. 

Allowing a ±10.0% deviation maintains accurate consumer information while recognizing inherent variability in the production of marijuana-infused products.
