FAQ How to compliantly proceed with a marijuana infused product that is not within ±10.0% of the actual number of milligrams of THC as displayed under the universal symbol for the packaging
On 3/3/2026, the Division of Cannabis Regulation issued a variance to allow licensees to display the intended or estimated milligrams of total THC content under the universal symbol. See Department-issued variance allowing intended milligrams to be displayed under the universal symbol.
This variance formalized a longstanding allowance that the milligrams displayed under the universal system may be within ±10.0% of the actual number of milligrams of THC from the mandatory testing results that are in the package and listed on the label required by 19 CSR 100-1.120(1)(C)2.G.
If a licensee produces and packages a marijuana infused product that falls outside of the ±10% intended or estimated milligrams for an approved packaging item, the licensee is in violation of rule.
A licensee has a few different options to remain in compliance and continue to move forward with the marijuana infused product. Here are a few examples:
- Select a similar approved final category item (only difference is intended total THC) within the statewide track and trace system (Metrc) that is within ±10.0% of the actual number of milligrams of THC from the mandatory testing results.
- Create and submit a new final category item within ±10.0% of the actual number of milligrams of THC from the mandatory testing results through the item approval process. Licensees may use stickers on packaging to change the milligrams of THC under the universal symbol if it is included in the information approved through the Item Approval Process. Contact your licensee’s Product Compliance Team facility specialist so they may better assist with this situation.
- Create a new final marijuana product and complete mandatory testing.
- Destroy the product.
