RE: Department-issued variance related to sample utilization and transportation for Inter-Laboratory Comparison Program
Testing Licensees,
Pursuant to 19 CSR 100-1.020(1)(A), the Division of Cannabis Regulation (DCR) is granting a variance to the requirements of 19 CSR 100-1.110(3)(E)2 and 3. Testing licensees will be considered compliant with the rule by complying with the following modified requirements.
Facilities must receive remaining sample material up to ten (10) times a year, at the direction of the department, from other licensed facilities or from the Department for testing.
The licensee receiving the marijuana product for testing will perform the sampling and be responsible for the transportation of the marijuana product, at the direction of the Department unless the Department has performed the sampling and transportation.
DCR has determined that good cause exists for granting this variance as it creates efficiencies in Inter-Laboratory Comparison (ILC) Program sampling utilization and may also result in reduced operational and financial responsibility for testing licensees.
