Use of humidity control packets in final marijuana product

On March 4, 2026, the Division of Cannabis Regulation (DCR) issued a variance to allow licensees to utilize humidity control packets (also known as moisture packets) after sampling marijuana product for testing. To include humidity control packets within final marijuana product packaging, licensees must:
- Maintain documentation demonstrating the humidity control packets are constructed from FDA-approved food contact substances.
- Notate within the designated area of the item approval application that humidity control packets will be included in final marijuana product packaging for the specific item.
For dispensary licensees that dispense marijuana product directly to patient and consumers in custom amounts, the variance allows them to use humidity control packets in their product storage containers provided the packets are constructed from FDA-approved food contact substance and the documentation to demonstrate compliance is maintained.
Licensees should be aware that humidity control packets are a potential source of contaminant that would not be identified through mandatory testing as it is included after sampling and may subject an item or items to recall if contaminant is found through investigation.
DCR will start verifying compliance with this requirement in January 2027.
