SUBJECT: Home and Community Based Services (HCBS) Policy Updates

3.25 Appendix 1 Consumer Directed Services Tax Information

Updated to include:

  • Increased emphasis on provider requirements
  • Additional information regarding the IRS 2678 form, ensuring completion by both the participant and CDS vendor
  • Updated documentation related requirements in Fusion
  • Formatting updates
4.00 Appendix 2e Consumer Directed Services Rights and Responsibilities

Updated to include:

  • Language added requiring both the participant and CDS vendor to complete IRS Form 2678
4.00 Appendix 2g Structured Family Caregiving Waiver Rights and Responsibilities

Updated to include:

  • Primary caregiver may have other employment if it does not affect the participant’s safety or health
4.15 Assessment Process

Updated to include:

  • The Provider Selection Section by removing the 15-day provider selection requirement and replaced with issuance of an adverse action allowing 10 calendar days for the participant to select a provider
5.00 Appendix 4 Application for State Hearing Instructions

Updated to include:

  • Language added that the form cannot be altered once it has been signed and saved

The revised policies have been posted in the HCBS Policy Manual.
