Topic: FAQ – 19 CSR 100-1.110(10)(B)2.A. Reanalyze the original sample collected for testing

Pursuant to 19 CSR 100-1.110(10)(B)2.A, a licensee may complete reanalysis of product that fails mandatory testing. Pursuant to 19 CSR 100-1.110(10)(B), licensees that intend to reanalyze a product that fails mandatory testing must do so within 3 months of initial test failure. Additionally, pursuant to 19 CSR 100-1.110(10)(B)1, licensees must notify DCR within 15 days of the test failure with their intent to reanalyze.

To complete reanalysis, a licensee will first have a testing licensee (that did or did not perform the initial analysis) use the initial mandatory sample collected from the source lot to reanalyze the analytes that failed mandatory testing. If a testing licensee does not have enough initial mandatory sample remaining to complete reanalysis, the testing licensee may resample the source lot.

Partial test results may be uploaded into the statewide track and trace system when performing the reanalysis.

After a sample passes reanalysis, a testing licensee that did not perform either the initial analysis or reanalysis shall sample the source lot and perform mandatory testing on the new sample in compliance with all rules for mandatory testing. The mandatory testing performed on the new sample must include all mandatory test analytes, including foreign matter.

Final marijuana products that pass reanalysis and the second mandatory test shall use the last testing results reported by the testing facility that performed the second mandatory test for all purposes as required within 19 CSR 100-1.120.
