NEW Consumer, Qualified Patient, and Caregiver Authorized Cultivation Cardholders Prohibited from Selling Marijuana Products

The Department of Health and Senior Services (Department), Division of Cannabis Regulation (DCR) is alerting consumer, qualified patient, and caregiver authorized cultivation identification card holders that they are strictly prohibited from selling marijuana/marijuana products produced from their cultivated plants. If a cultivation identification cardholder advertises to sell or sells marijuana products, the individual’s identification card may be revoked pursuant to 19 CSR 100-1.040 (6)(C)1.G. All marijuana product produced by the cultivated plants is for the exclusive use of the qualified patient, or for the non-commercial use of the consumer. For example, authorized cultivators are not legally authorized to sell marijuana products at a farmers market to patients or consumers. Information regarding consumer, qualified patient, and caregiver authorized cultivation is available below. Submit a complaint to DCR regarding consumer, patient, and caregiver cultivation identification card holders.

Article XIV of the Missouri Constitution only authorizes marijuana sales at state licensed dispensaries. Other businesses or individuals selling marijuana are doing so illegally, and can be reported to local law enforcement. The Department is committed to ensuring safe access for patients and consumers through marijuana sales at Department licensed dispensaries. Marijuana products purchased outside of licensed dispensaries have not been tested and may be unsafe for consumption. View a list of Department licensed dispensaries.

Consumer Personal Cultivation

Rules for Consumer Personal Cultivation

Individuals at least twenty-one years of age may obtain a consumer personal cultivation card from the department to cultivate up to six (6) flowering marijuana plants, six (6) nonflowering plants under 14 inches tall or more, and six (6) non flowering plants under 14 inches tall in a single enclosed locked facility. All consumer personal cultivation must take place at a private residence.
Two individuals who both hold valid consumer cultivation cards may cultivate their plants at one private residence provided they have both informed the department of this in their approved consumer personal cultivation application.
No more than twelve (12) flowering marijuana plants, twelve (12) nonflowering plants 14 inches tall or more, and twelve (12) nonflowering plants under 14 inches tall may be cultivated by consumers at a single private residence, regardless of the number of consumers who live at that private residence.
Plants and marijuana produced by the plants in excess of three (3) ounces must be kept at a private residence in an enclosed locked facility.
All cultivated flowering marijuana plants in the possession of a consumer shall be clearly labeled with the consumer’s name.
A consumer personal cultivation identification card shall be valid for 12 months from its date of issuance and shall be renewable with the submittal of a renewal application.

Guidelines for Consumer Personal Cultivation Licenses

All applications for consumer cultivation identification cards, including renewals, must include the following:

The name, address, and Social Security number of the applicant.
The address where the cultivation will be located.
If another consumer will be sharing the cultivation space, their name and application ID/Personal Cultivation License number will need to be included.
A Digital photo that shows a clear color image of the applicant’s face. This must not be a passport or the applicant’s ID and will appear on the approved license.
A government issued photo ID.
A $100 non-refundable fee.

Application Process:
Once a Personal Consumer Application has been submitted, the department will process the application; if corrections are needed or information is missing, the application will be rejected to allow applicants to make the needed corrections and resubmit the application. There is no additional fee for a rejected application to be corrected and resubmitted.

If a rejected application is resubmitted and has not been corrected, the application will be considered incomplete and will be denied. The department does not provide refunds for denied applications.

Once the application is approved, an email will be sent alerting the applicant that the license is available to download.

Consumer Personal Cultivation licenses are valid for one calendar year from the date of approval and must be renewed annually.

Steps to Apply for Consumer Personal Cultivation License

How-To Apply for a Consumer Personal Cultivation License:

Register
To complete an application, consumers will need to register with the department’s secure electronic registration portal.
- Consumer Personal Cultivation applicants will need to register as a Patient/Caregiver/Physician application type, not as a Business.
- If an applicant has previously registered for a patient/caregiver/physician type account, they will not need to re-register.
To register:
- Click “Register” in the top right hand corner of the registry page.
- From there, complete the requested information.
- Following registration, you will receive a verification email. Follow the link within the email to log into the registry portal
Apply
To create a consumer personal cultivation application:
1. Click “+Create New Application” in the top left corner.
2. Select “Consumer” from the dropdown.
3. Select “New Cultivation”
4. Click “Create Application.”
5. This will open a new consumer cultivation application. Complete all information required, then click “Save and Next” at the bottom of the page to continue through the application.
6. Payment information will be entered at the end of the application process, after clicking “Pay and Submit” on the Review tab.

How-to Change or Update an approved Cultivation License

Licensed consumer personal cultivators may change or update the details of the approved cultivation license by submitting an update application.

To submit an update application to change cultivation details:

Log into mo-public.mycomplia.com.
Click “License Dashboard” on the left side of the screen.
Choose the application that you would like to update, and click the actions column at the end of the row. It should look like three lines in a circle. Click “Consumer Update”.
From there the system will ask you a series of yes or no questions.
Change the answer from “no” to “yes’, on the question that applies to the area of your license you are wanting to change, and click “Save”. This will open your application so that you are able to make the update(s).
Click “Save and Next” at the bottom of each screen, updating the area(s) you are changing.
Once details have been changed, navigate to the “Review” tab by using “Save and Next” at the bottom of each screen.
Scroll to the bottom, and click “Submit”.

General Patient/Caregiver Cultivation Guidelines

Enclosed Locked Facility Definition and Multiple Cultivation Locations

A stationary, fully enclosed, locked space equipped with functioning security devices that permit access to only the consumer(s), qualifying patient(s), or primary caregiver(s) who have informed the department that this is the space where they will cultivate marijuana; and
The plants within the enclosed, locked facility must not be visible to the unaided eye from a public space.

Multiple Cultivation Locations

An applicant can only cultivate in one single location at any given time. However, an applicant can submit both an indoor and outdoor location description, provided that the applicant clearly specifies when they will be growing inside and when they will be growing outside.

Access Vs Sharing

Access refers to qualifying patients and caregivers who are accessing the space for the specific set of plants tied to the specific cultivation license. Only qualified, licensed patients and caregivers may have access to a cultivation space.

Sharing refers to approved qualifying patient cultivators who are growing their plants in the same cultivation space (enclosed locked facility) with one other licensed patient cultivator. Sharing in this context does not mean the sharing of cultivated plants, as the plants are for the exclusive use of that qualifying patient. Approved patient cultivators who are sharing a space must indicate this by answering “Yes” to the question “Will this cultivation space be shared?” on the Questions tab of the application. If the individual sharing the cultivation space has a pending application for cultivation, indicate “Applying for Cultivation”” within the “License number of Patient” field.

How-To Apply

Requests for authority to cultivate medical marijuana on behalf of a qualifying patient may be made by submitting a qualifying patient or primary caregiver application, or may be made at any time after a patient/caregiver ID is approved, so long as the ID card is still active and not expired.

Cultivation authorizations added to a qualifying patient or primary caregiver identification card will only remain valid as long as the qualifying patient or primary caregiver’s identification card is still valid. The cultivation application fee will be the same for all cultivation applications no matter how much time remains on the validity of the patient or caregiver’s identification card

Transport From One Enclosed Locked Facility to Another

Licensed patient and caregiver cultivators are allowed to move their plants to a new enclosed locked facility location. They may do this first and then submit an update. To remain in compliance, they should file the update within 14 days of the transfer to a new space.

Patient Cultivation Section

Qualifying Patient Cultivation

Licensed patients may obtain a patient cultivation card from the department to cultivate up to six (6) flowering marijuana plants, six (6) nonflowering plants under 14 inches tall or more, and six (6) non flowering plants under 14 inches tall in a single enclosed locked facility.
No more than twelve (12) flowering marijuana plants, twelve (12) nonflowering plants 14 inches tall or more, and twelve (12) nonflowering plants under 14 inches tall may be cultivated in a single enclosed, locked facility.
Under no circumstance will a qualifying patient be entitled to cultivate, or have cultivated on his or her behalf, more than six (6) flowering marijuana plants.
Only one individual in a patient-caregiver relationship may be authorized for cultivation on behalf of the qualifying patient.
All cultivated flowering marijuana plants in the possession of a qualifying patient shall be clearly labeled with the qualifying patient’s name.
A patient cultivation identification card shall be valid as long as the qualifying patient’s identification card is still valid, up to three years from its date of issuance.
1. The cultivation application fee will be the same for all cultivation applications no matter how much time remains on the validity of the patient’s identification card.
2. The cultivation identification card shall be renewable by submitting a renewal patient cultivation application, as long as the individual has an approved renewal patient application.

Shared Cultivation Spaces

Per Article XIV, only two qualifying patients, who both hold valid qualifying patient cultivation identification cards, may cultivate marijuana plants in one cultivation space, for a total of 12 flowering plants.

Adding to a New Application

Applicants may add cultivation to their New Patient application and submit the request with the patient ID card application.

To add cultivation to a New Patient application:

On the Questions tab of the application, select the slide bar next to “Do you intend to cultivate medical marijuana?”
This will change the answer to “yes”.
Applicants must then enter details of their cultivation location, security and access.
The cultivation address must be entered and verified.
There is also a question asking if this cultivation will be shared.
If the applicant will be the only cultivation license in that space, select “no”.
If the applicant will be sharing with other licensed cultivators, select ‘yes”.
Applicants will need to enter the names and license numbers of the other cultivator in the space.
If this person is also applying for cultivation, applicants may also type “Applying for cultivation license” in that space.

Please note: Applicable fees for cultivation licenses will need to be paid when submitting the request to add cultivation.

Licensed patient cultivators may change or update the details of the approved cultivation license by submitting a patient update application.

On the Questions tab of the application, licensees may make edits to any of the cultivation details.
Once details have been changed, navigate to the “Review” tab by using “Save and Next” at the bottom of each screen.
Scroll to the bottom, and click “Submit”.

Caregiver Cultivation Section

Rules for Caregiver Cultivation

Primary Caregiver Cultivation

A primary caregiver may cultivate on behalf of more than one (1) qualifying patient and may utilize one or more enclosed locked facilities.
No primary caregiver cultivating marijuana for more than one qualifying patient may exceed a total of twenty-four (24) flowering plants, twenty-four (24) nonflowering plants 14 inches tall or more, and twenty-four (24) nonflowering plants under 14 inches tall.
Only one individual in a patient-caregiver relationship may be authorized for cultivation on behalf of the qualifying patient.
All cultivated flowering marijuana plants in the possession of a primary caregiver shall be clearly labeled with the qualifying patient’s name.
A primary caregiver cultivator who is also authorized as a qualifying patient cultivator may grow the plants that belong to them as a qualifying patient cultivator and the plants grown on behalf of their qualifying patient(s) using the same enclosed locked facility.
A primary caregiver cultivator who is also authorized as a consumer personal cultivator may not grow the plants that belong to them as an authorized consumer personal cultivator and the plants grown on behalf of their qualifying patient(s) using the same enclosed locked facility.
A caregiver cultivation identification card shall be valid as long as the patient’s license and the primary caregiver’s identification card is still valid, up to three years from its date of issuance.
1. The cultivation application fee will be the same for all cultivation applications no matter how much time remains on the validity of the primary caregiver’s identification card.
2. The cultivation identification card shall be renewable by submitting a renewal caregiver cultivation application.

Shared Cultivation Spaces

Primary caregivers cultivating marijuana for more than one qualifying patient may cultivate each respective qualifying patient's flowering plants in a single cultivation space, not to exceed a total of twenty-four (24) flowering plants for more than one qualifying patient.
