NEW Consumer, Qualified Patient, and Caregiver Authorized Cultivation Cardholders Prohibited from Selling Marijuana Products

The Department of Health and Senior Services (Department), Division of Cannabis Regulation (DCR) is alerting consumer, qualified patient, and caregiver authorized cultivation identification card holders that they are strictly prohibited from selling marijuana/marijuana products produced from their cultivated plants. If a cultivation identification cardholder advertises to sell or sells marijuana products, the individual’s identification card may be revoked pursuant to 19 CSR 100-1.040 (6)(C)1.G. All marijuana product produced by the cultivated plants is for the exclusive use of the qualified patient, or for the non-commercial use of the consumer. For example, authorized cultivators are not legally authorized to sell marijuana products at a farmers market to patients or consumers. Information regarding consumer, qualified patient, and caregiver authorized cultivation is available below. Submit a complaint to DCR regarding consumer, patient, and caregiver cultivation identification card holders.

Article XIV of the Missouri Constitution only authorizes marijuana sales at state licensed dispensaries. Other businesses or individuals selling marijuana are doing so illegally, and can be reported to local law enforcement. The Department is committed to ensuring safe access for patients and consumers through marijuana sales at Department licensed dispensaries. Marijuana products purchased outside of licensed dispensaries have not been tested and may be unsafe for consumption. View a list of Department licensed dispensaries.
