Authorized Cultivation

Qualifying Patient

  • Cultivation must take place in an enclosed, locked facility.
  • May possess up to a 90-day supply with cultivation authorization so long as the marijuana product in excess of a 60-day supply remains in an enclosed, locked facility.
  • Non-emancipated (under 18 years of age) qualifying patients are not eligible, but may have a primary caregiver (parent or legal guardian) authorized to cultivate for them.
  • Allowed six flowering plants, six non-flowering plants (over 14” tall) and six nonflowering plants (under 14” tall)—limited to 18 plants in total.

Primary Caregiver

  • Cultivation must take place in an enclosed, locked facility.
  • May cultivate on behalf of up to six patients.
  • May possess up to 90-day supply per patient, so long as the supply in excess of a 60-day supply remains in an enclosed, locked facility.
  • Each patient’s supply must be stored separately and labeled with the qualifying patient’s name.
  • Allowed six flowering plants, six non-flowering plants (over 14” tall) and six non-flowering plants (under 14” tall) per patient.
  • If cultivating for more than one patient, cultivation may not exceed 24 flowering plants, 24 non-flowering plants (over 14” tall) and 24 non-flowering plants (under 14”) tall.

Consumer

  • Allowed six flowering plants, six non-flowering plants (over 14” tall) and six nonflowering plants (under 14” tall)—limited to 18 plants in total.
  • Flowering plants must be labeled with consumer’s name.
  • Plants and marijuana produced by the plants in excess of three ounces must be kept at a private residence in an enclosed, locked facility.

Public consumption of marijuana is not allowed. Article XIV does not permit driving or operating a motor vehicle while under the influence of marijuana. Consumption of marijuana product on the premises of a licensed dispensary, including in approved transport vehicles, is strictly prohibited.
