Pursuant to 19 CSR 100-1.020(1)(A), the Division of Cannabis Regulation (DCR) is granting a variance by modifying the provisions of 19 CSR 100-1.160(1)(A)2. Cultivation licensees will be considered in compliance with the rule by complying with the following modified requirement:
A cultivation licensee’s authority to engage in the process of cultivating marijuana includes the ability to . . . acquire and transfer marijuana seeds, plants, and other genetic material, such as tissue cultures, containing not more than 0.3% total THC, from entities not licensed under this chapter if doing so does not violate state or federal law.
DCR has determined that good cause exists for granting this variance because, beginning November 12, 2026, section 195.900, RSMo, classifies any part of the cannabis plant with not more than 0.3% total THC as legal hemp. Licensees should monitor DCR guidance to ensure they understand the Department’s interpretation regarding whether acquiring and transferring seeds, plants, and other genetic material is allowed under state and federal law as those laws change.
