If the department identifies a credible and imminent threat to public safety, it may order the licensed facility to immediately suspend all or part of its operations, including placing an administrative hold on marijuana product, until the threat has been resolved, pursuant to 19 CSR 100‑1.020(3)(G)1. Within the cannabis testing environment, there is inherent variability in equipment, methodologies, and analyst techniques. In recognition of this potential for variability, DCR supports the use of secondary or confirmatory testing, which may include additional testing or retesting when appropriate. For example, DCR’s process for routine sampling has always included confirmatory testing, and recalls have only been issued after multiple confirmations by the Reference Lab and a testing facility chosen by the licensee whose product failed a test.
Pursuant to 19 CSR 100-1.110(12)(A) and if necessary, DCR may have marijuana product tested at a marijuana testing facility, the Missouri State Public Health Laboratory, or any other lab authorized to conduct the required tests.
