Effective October 24, 2017, an Abortion Facility is any place – including a physician’s office or clinic – in which an abortion is performed or induced other than a hospital. Missouri state law (Section 197.205, RSMo) requires all Abortion Facilities to be licensed by the Department of Health and Senior Services (DHSS).
DHSS licenses Abortion Facilities and conducts annual, unannounced, on-site inspections and investigations regarding patient care provided in these facilities.
On October 24, 2017, Senate Bill 5 (HCS for SS for SB 5, 99th General Assembly, Second Extraordinary Session (2017)) takes effect. The bill changes some Missouri laws regarding abortion. This memo outlines DHSS’ plan for implementing the laws in Senate Bill 5 under DHSS’ jurisdiction.
The emergency and regular rules and rule amendments discussed in the memo and filed by DHSS on October 24, 2017, are available here.
Additionally, revised informed consent checklists and booklets compliant with Senate Bill 5 are available here.
