Breath Alcohol

The State Public Health Laboratory is responsible for providing scientific and technical oversight to our state’s operators, supervisors, training and technical instructors for the approximate 600 breath alcohol (BA) analyzers. These instruments are used to analyze the breath sample from an individual suspected of alcohol consumption.

The regulations cover the following:

Determination of alcohol or drugs from a sample of blood, breath, urine or saliva.
Approve satisfactory techniques.
Evaluate and approve breath analyzer instruments used in our state.
Approve equipment or methods to be considered valid.
Establish standards to ascertain the qualifications and competence of individuals to conduct analyses.
Issue permits to conduct analyses, which shall be subject to termination or revocation.
Provide scientific and technical testimony and consultation for DWI cases.

Permit Applications

Type 1 – fill-in form (form must be printed off and signed prior to submittal)
Type 1 permits are for laboratory persons who test for alcohol or drugs in blood, urine or saliva

Type 2 – fill-in form (form must be printed off and signed prior to submittal)
Type 2 permits are for persons authorized to supervise the breath analyzer, perform preventative monthly maintenance not to exceed 35-days, train Type 3 operators and perform breath tests on specified evidential breath analyzer

Type 3 permits are for persons authorized to perform breath tests on an evidential breath analyzer

Note: If the application includes a request for the applicant’s Social Security number, it must be provided as required by RSMo 324.024. DHSS will not disclose any applicant’s Social Security number except as required under RSMo 610.035. Any failure or refusal to provide your Social Security number is grounds for denial of your application.

Can I fax or email paperwork in to your office?

Yes, you may fax your maintenance reports, requests or applications. If faxing any paperwork, leave a number so that we may contact you if there is an error in transmittance. Faxing takes the place of mailing and is considered an original, so do not send hard copies via mail if you have faxed them. Ensure the legibility of each page before faxing. Fax number is 573-840-9139.

If you have a scanner, you may scan in your maintenance reports, requests or applications and email them to our office at breathalcohol@health.mo.gov. As with faxing, email takes the place of mailing and is considered an original, so do not send hard copies via mail if you have emailed them. Ensure the legibility of each page before emailing. Remember that all forms still require signatures, so always make sure that all forms are signed and completely filled out before scanning them and emailing.

What do I need to send in to you so that I can renew my Type 3 permit?

To renew your Type 3 permit, you will need to fax, email, or mail a completed Type 3 application completed per the instructions on the application. This is to include your original training information, the number of maintenance reports you performed in the last year of the permit, and the number of actual DWI’s you performed in the last year of the permit (at least 10).

If this condition has not been met, you will need to perform 5 self-administered breath tests, each with an operational checklist or the second page of the AIR form. You must also complete a two hour refresher course under the supervision of a valid Type 2 permit holder on the instrument for which you are submitting for renewal. You must attach copies of the BA log for the actual DWI’s performed or the self-administered tests and operational checklists. The information concerning the 2 hour refresher course needs to be listed under the Original Training Courses section of the Type 3 application.

Retain copies of everything sent to us until you have received your permit from us. This will help relieve any aggravation associated with items getting lost in the mail.

What do I send in with my new Type 3 permit applications?

If you are a Type 2 and you are submitting the applications of your newly trained Type 3’s, you must send us three (3) items for each applicant: 1) A completed and signed Type 3 permit application, 2) a copy of their final written exams, and 3) a copy of the ten self-administered tests and operational checklists for the course that they have just completed.

If you are a Type 3 applicant and your training was performed by a training academy, you will need to contact the training academy to obtain the necessary paperwork for submittal.
Be sure to retain copies of everything sent to us until you have received your permit from us. This will help relieve any aggravation associated with items getting lost in the mail.

What if my Type 3 permit has expired?

As soon as a permit expires, it can no longer be used. There is no grace period for the use of a permit.
If your Type 3 permit is still within the 30-day period from the expiration date and you performed tests on at least ten DWI subjects in the past year, you will need to submit a completed Type 3 application and a copy of the BAC log showing that you had performed these tests.

If you have not performed tests on ten DWI subjects, you need to submit a completed Type 3 application and must also perform five self-administered breath tests, each with an operational checklist or the second page of the AIR form. You must also complete a two hour refresher course under the supervision of a valid Type 2 permit holder on the instrument for which you are submitting for renewal.

For any permit expired more than 30 days but less than one year, you will need to perform five self-administered breath tests with operational checklists, and complete a two hour refresher course, regardless of the number of DWI subject tests performed.

Information concerning the two hour refresher course needs to be listed under the Original Training Courses section of the Type 3 application.

Once a permit is expired by one year or more, applicants must complete the entire Type 3 operator course again.

What do I need to submit to you if I want to conduct a Type 3 class?

Type 3 Operator training must be conducted utilizing the Department of Health and Senior Service’s Breath Alcohol Program Standardized Type 3 training materials. Training conducted not utilizing the approved materials will result in the training class and the subsequent applications for permits not being approved. The approved standardized materials are available free of charge from the Missouri Department of Health and Senior Service’s Breath Alcohol Program upon request. The Breath Alcohol Operator Manual is required to be provided as part of the Type 3 training materials.

New Type 3’s need a minimum of twelve hours of training, which includes training on the specific evidential breath alcohol instrument. For a current Type 3 to change to a different evidential breath alcohol instrument is a minimum four hours training, including a written exam over the new instrument.

Prior to conducting Type 3 training, a Type 2 permit holder will need to submit a letter asking for approval to perform the Type 3 training to the Breath Alcohol Program. In the letter you need to include: the location of the class, the type of class (twelve hours for new a Type 3 permit or four hours for a new instrument), the dates of the class, instructor(s), and approximate number of students. In addition, you must include a copy of the course outline showing the version of the approved standardized training material being used, as well as the alternate topics covered and the number of hours devoted to each. Additional topics beyond the standardized twelve hours may be covered, but are not required.

What if I have a current permit for one BA instrument and now need training on another, in addition to the current BA instrument?

The addition of another BA instrument to an applicant’s permit requires a minimum four-hour course on the BA instrument, complete with written exam and ten self-administered breath tests, each with an operational checklist.

If you would like to have both BA instruments on one permit, renewal procedures for the current BA instrument must be met at the time the application request is made for new BA instrument. You must have performed at least ten actual DWI subjects in the last year of that permit and submit the copy of the BA log for those tests with your application. If this condition has not been met than you will need to perform five self-administered breath tests, each with an operational checklist or the 2nd page of the AIR form. You must also complete a two hour refresher course under the supervision of a valid Type 2 permit holder on the instrument for which you are submitting for renewal.

For the Type 2 permit holder to conduct this training, the standards listed above describing What do I need to submit to you, if I want to conduct a Type 3 Class? must be met.

What do I need to send in to you so that I can renew my Type 2 permit?

To renew your Type 2 permit, you will need to fax, email, or mail a completed Type 2 application completed per the instructions on the application. This is to include your original training information, the number of maintenance reports you performed in the last year of the permit (at least two), and the number of actual DWI’s you performed in the last year of the permit (at least ten).

If these conditions have not been met, or if the permit is expired by 30 days or more, you will need to perform 5 self-administered breath tests, each with an operational checklist or the second page of the AIR form. You must also perform at least two maintenance reports on your instrument for renewal purposes, each with a copy of all evidence tickets, the solution certificate of analysis, and a copy of your previous Type 2 permit.

Your permit application must have the attached copies of the BA log for the actual DWI’s performed, as well as copies of at least two maintenance reports performed, or must include the self-administered tests, operational checklists, and renewal maintenance reports with all requisite paperwork. Be sure to retain copies of everything sent to us until you have received your permit from us. This will help relieve any aggravation associated with items getting lost in the mail.

What is required to become a Type 2?

You must be at least 21 years of age and employed by the law enforcement agency that owns the Breath Analyzer instrument. There may be two Type 2’s per instrument at each agency. It is expected that each Type 2 will have hands-on proficiency with the instrument and will perform an equal share of the monthly maintenance reports. The BA instrument responsibilities should be shared equally.

An approved training course is required before a permit may be issued from the Breath Alcohol Program. Prior approval from DHSS is necessary to attend either of the training facilities in order to acquire Type 2 training.

There are two primary training facilities; the Missouri State Highway Patrol Academy located in Jefferson City, and the University of Central Missouri, Missouri Safety Center located in Warrensburg.

What paperwork do I send in for my monthly maintenance report?

R.F.I., the Certificate of Analysis and a copy of your current Type 2 Permit should be received by DHSS within 15 days of the performance of the maintenance report(s). Remember that you always keep the originals.

For the Intoxilyzer 5000: Copies of the evidential printouts of the: Diagnostic Check, Print Test, Calibration Check, and R.F.I., the Certificate of Analysis and a copy of your current Type 2 Permit should be received by DHSS within 15 days of the performance of the maintenance report(s). Remember that you always keep the originals.

For the Alco-Sensor IV (ASIV): Copies of the evidential printouts of the: Diagnostic Check, Calibration Check, and the R.F.I., the Certificate of Analysis and a copy of your current Type 2 Permit should be received by DHSS within 15 days of the performance of the maintenance report(s). Remember that you always keep the originals.

For the Intox DMT, Intoxilyzer 8000 and Intox EC/IR II: A copy of the maintenance report printout from the instrument’s printer, the Certificate of Analysis for the standard used and a copy of your current Type 2 Permit should be received by DHSS within 15 days of the performance of the maintenance report(s). Remember that you always keep the originals.

Only one Type 2 permit holder shall perform and sign the Maintenance Report.

If I am having instrument problems, whom do I contact?

If you happen to experience any problems with your BA instrument, you should contact us first at 573-840-9140. We need to be aware of any problems and what type of problems may be occurring with the instruments.

We are Manufacturer-trained on the BA instruments, and stay current with annual updates provided by the manufacturer. We do know how to troubleshoot problems with the instruments and perform repairs. Most problems can usually be resolved over the phone. If not, we can direct you to the appropriate place.

How many breath analyzer instruments do we have in use within our state?

We have approximately 650 breath analyzers (BA instruments) in use within our state:

In addition to the BA instruments in use within our state there are approximately 19 Breath Alcohol Testing (BAT) Vans. These are specially designed and equipped vans used mostly for Sobriety Check points.

Note: These numbers are estimates only, as these instruments are taken out of service and placed into new service regularly.
